However, it is extremely important that legislation relating to occupancy and safety of rented property is adhered to as failure to meet these obligations can lead to severe penalties.
IMPORTANT LANDLORD SAFETY REGULATIONS
Gas Appliances and Equipment
Under the Gas Safety (Installation & Use) Regulations 1997 (Amended 1996), all gas appliances in tenanted premises must be checked for safety at intervals of not more than 12 months, by a CORGI registered gas engineer, and a safety certificate issued. This is to prevent the risk or injury to any person in occupation of rented premises. As a Landlord you must ensure that each appliance and flue to which that duty extends is checked for safety within twelve months of being installed, and at intervals of not more than twelve months since it was last checked for safety. As a Landlord you must also ensure that a record in respect of any appliance or flue is retained for a period of two years from the date of that check. The records must include the following information:-
1. The date of which the appliance or flue is checked.
2. The address of the premises at which the appliance or flue is installed
3. The address of the Landlord of the premises (or where appropriate, his Agent) at which the appliance or flue is installed for a description of other location of each appliance or flue checked.
4. Any defect identified.
5. Any remedial action taken.
6. Confirmation that the check they were undertaking complies with the requirements of these regulations.
7. The name and signature of the individual carrying out the check.
8. The registration number which that individual or his employer registered with the body approved by the Health & Safety Executive.
If any remedial works are needed then that work must be carried out.
Furniture
Where furniture is supplied as part of the tenancy, it must comply with the Furniture and Furnishings (Fire) (Safety) Amendment Regulations 1993.
This legislation requires all soft furnishings to pass what is referred to as the 'Cigarette Test' and in order for this to be established beyond doubt the furniture must have the manufacturers label confirming this fact. The regulations apply to all upholstery, including settees, chairs, loose covers and cushions, mattresses and pillows. At the present time carpet and curtains are excluded from the regulations.
Electrical Installation and Equipment
It is recommended that a reputable electrical contractor (preferably NICEIC Approved) carry out detailed safety tests on all electrical installations and appliances. This will ensure compliance with the IEE wiring Regulations.
Smoke Alarms
It is recommended and may become essential that smoke alarms are fitted to all floors.
Carbon Monoxide (CO) Safety Report - it is also strongly recommended that where any gas appliance is installed a Carbon Monoxide Safety Report is undertaken as Carbon Monoxide poisoning can be fatal and result in severe penalties for Landlords.

Energy Performance Certificates
From 31st December 2008 it will be a legal requirement for all landlords to have a valid EPC for their property before it can be let. BTWCairns can provide contact details for registered assessors.
What is an EPC?
An EPC assesses the energy performance of a property, from "A" representing the most energy efficient property to "G" representing the least energy efficient property. It must be carried out by a qualified Domestic Energy Assessor and will also show a building's environmental impact by indicating its carbon dioxide emissions.
How long is an EPC valid for?
A valid EPC will last for 10 years and can be used for multiple tenancies within that period.
